Fair Housing Law

Federal and state fair housing laws prohibit discriminatory practices in any industry-related business or transaction that may affect the ability of protected class members to secure housing and/or live in the housing of their choice.

What the City of Missoula Does

Affirmatively Further Fair Housing (AFFH)

As a recipient of U.S. Department of Housing and Urban Development (HUD) funding, the City of Missoula:

  • Maintains a current Assessment of Fair Housing (AFH).
  • Identifies barriers to fair housing choice in Missoula.
  • Integrates fair housing goals into housing and community development plans, land use and zoning policies, and capital investments and infrastructure decisions.
  • Reports progress to HUD through required planning and performance documents.

Information Sharing and Referrals

While not an enforcement agency, City staff:

  • Provide general information about fair housing rights.
  • Refer residents, landlords, and providers to appropriate state or federal agencies.
  • Coordinate with partners when fair housing issues intersect with City programs or policies.

What the City of Missoula Does Not Do

Due to limited authority, the City does not:

  • Investigate housing discrimination complaints
  • Make legal determinations about discrimination
  • Enforce state or federal fair housing laws
  • Serve as an adjudicator or appeals body for housing discrimination claims
